WHAT THIS NOTICE COVERS
This notice applies to people who visit our website or contact us through the website form, by email or by telephone. Separate privacy information may apply if an enquiry later becomes a referral, placement, learner record, safeguarding record, complaint or legal matter.
PLEASE DO NOT SEND SENSITIVE INFORMATION THROUGH THE GENERAL ENQUIRY FORM
Please do not include medical, safeguarding, criminal-allegation or other sensitive personal information in this general enquiry form. If your enquiry concerns a learner referral or sensitive information, contact us first so that we can arrange an appropriate way for you to provide it.
THE INFORMATION WE COLLECT

Our website contact form asks for your first name, last name, email address and message. We may also collect:

information you provide during necessary follow-up correspondence;

your telephone number or other contact details if you choose to provide them;

information about the service or support you are asking about; and technical information generated when you use the website, such as your IP address, browser and device information, pages viewed and cookie or similar-technology data.
If sensitive information is sent to us despite the request above, we will limit its use and access to what is necessary and lawful.
WHY WE USE PERSONAL INFORMATION AND OUR LAWFUL BASES
NYHA uses website-enquiry information to receive, consider and respond to enquiries, maintain proportionate records of communications, arrange necessary follow-up, protect the rights and safety of individuals, and comply with legal obligations.
The lawful bases for this processing are:

Article 6(1)(f), legitimate interests, for receiving and answering ordinary website enquiries, including enquiries from schools, local authorities and commissioners, arranging necessary follow-up and keeping proportionate communication records. Our legitimate interests are operating a responsible enquiry service, communicating effectively, keeping an appropriate record of what was asked and how we responded, protecting our legal position and safeguarding people where necessary. We consider the nature of the information, the reasonable expectations of the people concerned and the possible effect on their privacy.

Article 6(1)(b), steps requested before entering into a contract, only where an individual asks NYHA to take steps towards a private service or contract involving that individual. NYHA does not use contract as the general lawful basis for third-party commissioner or learner information.

Article 6(1)(c), legal obligation, where a specific legal duty requires processing or disclosure.

Article 6(1)(d), vital interests, only in genuinely life-critical circumstances where processing is necessary to protect someone’s life.
NYHA does not use public task or routine consent as the basis for receiving and answering ordinary enquiries.
GENERAL ENQUIRIES, REFERRALS AND PLACEMENTS
The public contact form is primarily for general enquiries. It is not NYHA’s formal learner-referral form.
If an enquiry develops into a requested referral or placement, only relevant information will be transferred into NYHA’s separate, secure referral or learner-record system. That information will then be managed under the applicable referral, learner, safeguarding and education-record arrangements. Unnecessary duplicate copies should not be retained in Wix merely because the matter has progressed.
SAFEGUARDING, SPECIAL-CATEGORY AND CRIMINAL-OFFENCE INFORMATION
Where necessary safeguarding processing is carried out and the relevant legal conditions are met, NYHA may rely on Article 6(1)(f), legitimate interests, or Article 6(1)(c), legal obligation, as applicable.
Special-category safeguarding information may be processed under Article 9(2)(g) of the UK GDPR and Schedule 1, Part 2, paragraph 18 of the Data Protection Act 2018 where those provisions apply.
Criminal-offence information may be processed under Article 10 of the UK GDPR and the applicable Schedule 1 safeguarding condition, including Schedule 1, Part 2, paragraph 18 of the Data Protection Act 2018 where it applies.
Any safeguarding processing must be necessary, proportionate and limited to relevant information. Relevant information may be disclosed where necessary or legally permitted to NYHA’s Designated Safeguarding Lead or Deputy Designated Safeguarding Lead, the learner’s host school, a commissioning body, local-authority safeguarding services, social care, the police or another legally authorised body.
WHO CAN ACCESS THE INFORMATION AND WHO PROCESSES IT
Website enquiries are accessible only to authorised NYHA staff who need the information to respond or manage any necessary follow-up. Wix processes the form submission, and Google Workspace processes the associated email notification.
Form information may be held in Wix Forms, Wix Inbox and Wix Contacts. Google Workspace is NYHA’s email provider and processes the corresponding notification email. Wix also hosts the website and provides related security, performance and website services.
Completing the form does not mean that information is routinely shared with schools, local authorities, commissioners or other organisations.
INTERNATIONAL PROCESSING
Wix and Google operate internationally, so personal information processed through their services may be handled outside the United Kingdom. NYHA has not yet verified the exact international-transfer mechanism that applies to its use of each service, and this draft does not make a claim about that mechanism. Where UK data-protection law requires safeguards for an international transfer, the relevant arrangement must use a lawful mechanism.

HOW LONG WE KEEP WEBSITE ENQUIRIES
From 11 August 2026, ordinary website enquiries that do not become referrals, placements, safeguarding records, complaints or legal matters will normally be retained for no longer than 12 months after the last meaningful contact.
This applies to copies held in Wix Forms, Wix Inbox, Wix Contacts and corresponding notification emails. NYHA will review these records periodically and delete them when they are no longer required. This is a review-and-deletion rule; it does not mean that Wix has been configured to delete records automatically.
Information may be retained for longer where reasonably necessary for an ongoing complaint, safeguarding concern, legal claim or other legal obligation. If an enquiry becomes a referral, placement or learner matter, relevant information transferred to the separate record system will be kept under the retention arrangements that apply to that record.
DIRECT MARKETING, PROFILING AND AUTOMATED DECISIONS
NYHA does not use contact-form information for direct marketing. We do not profile people using website-enquiry information, and we do not make solely automated decisions about enquiries, referrals, placements or learners.
YOUR DATA-PROTECTION RIGHTS
Depending on the circumstances and the lawful basis used, you may have the right to:
• be informed about how your personal information is used;
• ask for access to the personal information we hold about you;
• ask us to correct inaccurate or incomplete information;
• ask us to erase personal information;
• ask us to restrict how personal information is used;
• receive personal information in a portable format where the right applies;
• object to certain processing; and
• withdraw consent where processing is based on consent.
These rights are not absolute, and a legal exemption may apply. We may need to confirm your identity before acting on a request.
YOUR RIGHT TO OBJECT
Where NYHA relies on legitimate interests, you have the right to object to the processing based on your particular situation. We will stop unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims.

COOKIES, ANALYTICS AND EXTERNAL LINKS
This website uses essential and optional technologies. Essential technologies are required for core website operation and cannot be switched off through the consent tool. A Usercentrics scan completed on 11 August 2026 identified Wix/Wix CMS as a Wix standard component in the essential category. Usercentrics describes it as a website-content creation and analysis service.
The Contact page provides a standard external “Get directions” link to Google Maps. No Google map, Google iframe, Google widget or Google preview loads on the NYHA website. Google services load only if a visitor actively follows the external link and leaves the NYHA website or opens Google Maps in a new tab. External websites are governed by their own privacy information.
Optional categories remain disabled unless a visitor positively selects them. When the banner is shown, visitors can select “Accept All” to permit optional categories, “Deny” to reject optional categories, or “More Information” to review detailed settings and use “Save Settings”. A privacy trigger appears on all pages so visitors can reopen the consent tool and change or withdraw their choice later.
The banner links to this Website Privacy Notice. The consent tool provides the current declared component information and category choices. Where Wix or Usercentrics has not supplied a verified storage duration, this notice does not invent one.
